These Terms of Service ("Terms") govern your use of the Endeavor Music Publishing LLC ("Publisher," "we," "us," or "our") website and the purchase of products. By placing an order or using our website, you agree to these Terms.

1. Products and Pricing

All products are offered at Publisher's current list prices as displayed on the website. Prices are subject to change without notice. We reserve the right to correct any pricing errors.

Products are available in two formats:

  • Physical Print: Printed octavo shipped via USPS or UPS
  • Digital ePrint: PDF download for authorized printing

2. Digital ePrint License

When you purchase a Digital ePrint, you are purchasing a license to print a specified number of copies for use by your ensemble or organization. This license grants you:

  • The right to print the number of copies purchased
  • The right to make archival backup copies
  • Use of the printed copies for rehearsals and performances

You may NOT:

  • Share, distribute, or resell the digital file
  • Print more copies than purchased without obtaining additional licenses
  • Remove or alter copyright notices or watermarks
  • Upload the file to any website or file-sharing service

Each ePrint is watermarked with the purchaser's information for copyright protection. Violations of this license may result in legal action.

3. Orders and Payment

All orders require payment at the time of purchase. We accept major credit cards through our secure payment processor, Stripe. By providing payment information, you represent that you are authorized to use the payment method.

Sales tax is collected where required by law, calculated based on the shipping destination.

4. Shipping and Delivery

Physical Products: Orders typically ship within 1-2 business days. Delivery times vary by shipping method selected. Risk of loss transfers to you upon delivery to the carrier.

Digital Products: ePrint downloads are available immediately upon successful payment. Download links are sent to the email address provided.

5. Returns and Refunds

Physical Products: Unused products in original condition may be returned within 30 days of purchase for a refund, minus shipping costs. Damaged or defective products will be replaced at no charge.

Digital Products: Due to the nature of digital downloads, ePrint purchases are non-refundable once the download link has been accessed. If you experience technical issues, please contact us for assistance.

6. Intellectual Property

All products, including musical compositions, arrangements, and associated materials, are protected by copyright. Publisher holds or is authorized to distribute all works in our catalog. Unauthorized reproduction, distribution, or public performance may violate copyright law.

7. Performance Rights

Purchase of sheet music grants the right to perform the work. For public performances in venues that require licensing (concerts, broadcasts, etc.), you may need to obtain a performance license from the appropriate performing rights organization (ASCAP, BMI, or SESAC). Publisher is not responsible for obtaining performance licenses on your behalf.

8. Limitation of Liability

Publisher's total liability arising under these Terms shall not exceed the purchase price of the applicable products. Publisher shall not be liable for indirect, incidental, special, or consequential damages.

9. Indemnification

You agree to indemnify and hold harmless Publisher from any claims, damages, or expenses arising from your violation of these Terms or misuse of our products.

10. Modifications

Publisher may modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the website after changes constitutes acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Missouri. Any dispute arising under these Terms shall be brought in a court of competent jurisdiction located in Jackson County, Missouri.
